Policy 11:1 - South à£à£Ö±²¥Ðã Art Museum

  1. Purpose

    This policy sets forth the provisions applicable to the operation of the South à£à£Ö±²¥Ðã Art Museum at the University to ensure compliance with applicable legal and policy provisions.

  2. Policy

    The South à£à£Ö±²¥Ðã Art Museum is operated as a state owned campus building pursuant to SDBOR control and all applicable SDBOR and University policies and state law. The South à£à£Ö±²¥Ðã Art Museum and its holdings are valuable and essential intellectual and educational resources to the state of South à£à£Ö±²¥Ðã and for the University to achieve its missions, and its operations are subject to the following policy.

    1. The South à£à£Ö±²¥Ðã Art Museum and the collections in its care have important intellectual and educational value to the state of South à£à£Ö±²¥Ðã and the University.
       
    2. The control, management, and operation of the South à£à£Ö±²¥Ðã Art Museum by the SDBOR and University is subject only to the uses by the South à£à£Ö±²¥Ðã Federation of Women’s Clubs as set forth by SDCL §13-58-19. The University is responsible for and shall perform all the functions of the South à£à£Ö±²¥Ðã Art Museum, including business operations, accession, de-accession of holdings, and operation and maintenance expenses.
       
    3. South à£à£Ö±²¥Ðã Art Museum Advisory Board and Director
      1. The purpose of the Advisory Board is to provide advice to the University President or designee via the Art Museum Director on the operations of the Art Museum. The Advisory Board, which shall be appointed by the University President, may advise on matters such as:
        1. General operating policies,
        2. Selection, with the University President, of the Director of the Art Museum,
        3. Programs and activities at the Art Museum,
        4. Development of policies for acceptance and de-accession of works of art and other gifts.
      2. The Advisory Board may assist with and advise on:
        1. Activities to secure public understanding of the nature and activities of the Art Museum,
        2. Identifying and cultivating means of support for the Art Museum.
      3. The Advisory Board will develop, and review annually, by-laws consistent with this policy and applicable laws and provide a copy to the President, or designee, who may approve or reject for inconsistency with applicable provisions.
      4. The South à£à£Ö±²¥Ðã Art Museum Director prepares the annual operating budget and shares it with the Advisory Board.
         
    4. South à£à£Ö±²¥Ðã Art Museum Holdings
      1. South à£à£Ö±²¥Ðã Art Museum holdings are owned by the University and the state of South à£à£Ö±²¥Ðã.
      2. Acceptance and de-accessioning policies will be followed with regard to South à£à£Ö±²¥Ðã Art Museum holdings of the University. South à£à£Ö±²¥Ðã Art Museum will take appropriate steps to incorporate to the extent allowed by applicable law, standards from the applicable accrediting body into said policies.
      3. The South à£à£Ö±²¥Ðã State University Foundation, Inc. may assist the University and South à£à£Ö±²¥Ðã Art Museum in acceptance and de-accessioning of works or other items in accordance with applicable agreements, policies and law.
  3. Responsible Administrator

    The Provost, successor, or designee is responsible for bi-annual and ad hoc review of this policy. The University President is responsible for approval of this policy.
